Terms and Conditions (The following Terms and Conditions also contain statutory information on your rights pursuant to the regulations concerning contracts in remote sales and in electronic business operations.) 1. Scope of Application These Terms and Conditions shall apply to any and all deliveries made to consumers (s. 13 German Civil Code, BGB) by Sport EDER - Wolfgang EDER – Stefan BERGER – Silvia EDER GbR (hereinafter called Sport EDER). 2. Contractual Parties The Sales Contract is concluded with Sport EDER – Wolfgang EDER – Stefan BERGER – Silvia EDER GbR. For any questions, claims or complaints, please call 0049/ 8503/ 8610 from 9 a.m. until 12 noon on weekdays and from 2 p.m. until 6 p.m. on Mondays, Tuesdays, Thursdays and Fridays. Offer and Conclusion of Contract 3.1 Any display of products in the online shop does not constitute a legally binding offer, but merely an invitation to order. All offers are valid “while stock lasts”, unless otherwise stated with a certain product. Barring errors. 3.2 By clicking the [ORDER] button, you make a legally binding order of the goods listed on the ordering page. The sales contract is concluded when we accept your offer by sending an email confirming the order after receiving it. 4. Right of Revocation 4.1 Cosnumers have a legal right of revocation (§ 13 BGB, German Civil Code).
4.2 There shall be no right of revocation in the case of delivery of goods which have been manufactured according to the customer's specification (e.g. made-to-measure suits) or which have been obviously made to match personal needs, or in the case of delivery of audio or video material or software if the seal has been removed by the customer. 4.3 Please ensure not to damage or dirty the goods. If at all possible, please return the goods in the original packaging including all accessories and packing material. Use protective secondary packaging where applicable. Should you not have the original packaging any more, please protect the item from damage during transport by using appropriate packaging. 4.4 Please return the item to us as an insured parcel and keep the certificate of posting. We can also refund you the shipping costs in advance if you wish, unless they are to be borne by you. 4.5 Please give us a call on 0049/ 8503 86 10 beforehand to notify us of a return. This enables us to deal with returned items as fast as possible. 4.6 Please note that the conditions named under 4.3, 4.4 and 4.5 are not conditions for the valid use of your right or revocation. 5. Prices and delivery costs 5.1.The prices mentioned in the product description contain VAT and other price components. 5.2. In addition to the stated prices we charge the following amounts for delivery and postage. The prices stated on the product pages include VAT. Delivery 6.1 Delivery is available into the countries mentioned in 6.2. 6.2 The estimated delivery periods are: Germany, Austria, Denmark approx. 1-2 working days Belgium, Netherlands, Luxemburg approx. 1-2 working days Czech Republic, Italy approx. 2-3 working days France, UK approx. 2-3 working days Poland, Hungary approx. 2-3 working days Switzerland, Liechtenstein approx. 2-3 working days 7. Payment 7.1 Acceptable forms of payment are: cash in advance, credit card, direct debit, financing through the CC-Bank. 7.2 Should you wish to pay in advance, please transfer the amount due to the acount stated below:
We shall deliver upon receipt of payment. 7.3 You shall only have a right to compensation if your counter-claims have been ascertained by a legally binding court decision or are undisputed or have been acknowledged by us in writing. 7.4 You may only make use of a right of retention if the claims arise from the same contractual relationship. 7.5 If you wish to pay via direct debit, your account will be debited upon delivery of the goods. 7.6 If you wish to pay by credit card, your account will be debited upon delivery of the goods. 8. Retention of title We shall retain ownership of the goods until the full price has been paid. 9. Warranty Warranty is applicable in accordance with statutory regulations. Should any faults occur within the statutory warranty period of two years, you have a legal right to reperformance (to be chosen by you: remedy of the fault or new delivery) and - if legal conditions are met - the legal rights to reduction of payment or revocation of contract, as well as the right to damages. You can view the Terms and Conditions at any time on this page. You will receive an email with your order details and the Terms and Conditions. After the order has been completed, the contractual text will not be available via the internet any longer for security reasons. Data Protection We will only collect personal data if you voluntarily inform us of them when ordering goods, opening a customer account or registering for our newsletter. We will use these data only for processing and completing your order, unless you expressly agree otherwise. Upon completion of the contract and full payment of the sales price, your data will be made inaccessable for further use and will be deleted once the regulations stipulated by tax and trade laws have ceased to apply, unless you have expressly consented to the further use of your data. When signing up for the newsletter, your name and email address will be used for advertising purposes subject to your consent, until you cancel your registration.
